The Lawsuit Against Minecraft Is Actually Happening

At the time of releasing this video, there are lawyers actively working on a class action lawsuit against Mojang. Yes, it is actually happening. Now, in case you completely missed what this is all about and you also didn’t watch the two videos I made about this previously, let me quickly catch you up to speed. So, about 8 months ago, YouTuber Keon Bruce released a video on his channel called Suing Minecraft because they broke the law and pissed me off. Now, in that video, Keon explains that Moing has broken the law on multiple occasions, and that’s now because he is personally affected by it, he plans to launch a lawsuit against them. For a bit more context, Keon planned on releasing a Minecraft server which included guns. And you might be thinking to yourself, Kasai, aren’t guns forbidden in Minecraft? Well, yes, now they are. But they weren’t back then. So Kian started creating this server and when it was almost time to release it, Moang all of a sudden announced, well, they didn’t really announce it. They just pushed an EOA update without notifying anyone and all of a sudden it was no longer allowed to have guns on a Minecraft server. Now, what they did there that that very sneaky thing where they change their EUA, but they don’t announce it publicly and don’t even require users to accept the new EUA, that is against the law. At least it is in Europe. And that matters a lot here because the creators of Minecraft, Mojang, are a European company. They are located in Sweden. And the headquarters of Mojang is still in Sweden. So, they obviously have to follow European law. And even if they were not a European company, they are still actively doing business in Europe, which means that European law applies nonetheless. Another great example of Mojang changing the EOLA, not announcing it publicly, and after that enforcing the EUA even though users didn’t explicitly accept it, is the whole Minecraft account migration fiasco. So, for those who remember, back in the day, we used to all play Minecraft with a Mojang account. But in 2020, Microsoft decided that from now on, all Minecraft accounts would be linked to a Microsoft account instead. They said they would do this for better security because Mojang accounts didn’t have things like 2FA. But the way they did it, that is where problems start to arise because they didn’t say, “Hey, you now have an option to migrate to a Microsoft account. We would highly recommend this. No, they said if you don’t migrate your Microsoft account, we will literally terminate your account. Essentially deleting something that you paid money for. Now, that is no longer a suggestion. That is just a threat. They straight up said if you do not migrate right now to a Microsoft account, your Minecraft account will be deleted. You didn’t have any choice whatsoever to not agree to this. Well, you could do that, but they would just delete your account. They would delete something you paid for. And by migrating to a Microsoft account, you all of a sudden also had to agree to Xbox EUA and Microsoft’s EUA. And if you didn’t want to do that, if you didn’t want to give Microsoft your data, then okay, that’s that’s fine. But now you will just no longer have Minecraft. Yeah, that’s not okay. That’s not that’s not okay. No matter if you like the Microsoft account migration or not, threatening your users to just delete their accounts while still saying it is voluntary in some documents. That is just that is not no bad bad Microsoft. So Kian released that initial video 8 months ago and at the end of that video he included a Goofund me not because he really thought they were going to achieve anything but might as well give it a shot. Well, the video kind of blew up and gained over $150,000, which meant that all of a sudden there was funding for an actual lawsuit. And uh that lawsuit is happening now. Now, at the time of releasing this video yesterday, Kian released an update video to his channel about this whole lawsuit where the moral of the story is basically that um it’s happening. It’s going to happen. But for the lawsuits to succeed, he does need your help. So basically, for this class action lawsuit to succeed, Kian and his lawyers have to prove that whatever Mojang and Microsoft did, for example, in terms of the Minecraft account migration affected a big group of people. And we’re pretty sure it did. After Mojang started terminating accounts that didn’t migrate to a Microsoft account, a lot of people lost Minecraft right there and then. Maybe they didn’t even know it was happening. We don’t need to forget that not everyone is constantly online and yeah, well then your account is gone. Now, the reason I keep bringing up account migration, even though the initial incident which sparked the lawsuit was the gun server, which Kon couldn’t release, is because the account migration is just a really, really great example of how Mojang simply broke the law. changing the EUA without notifying users, enforcing the EUA on users that didn’t accept it, and threatening users to delete their accounts if they wouldn’t give their data to a big corporation. All of that is not okay. So, how can you help? There is a participation form in the description down below. Basically, the form will ask you how you were negatively affected by all of this, and it’s pretty simple. The more responses they get, the higher the chance of this lawsuit actually succeeding. And I know there are going to be some people who now think, “Oh, no. I hope this lawsuit is not going to happen. Minecraft will shut down as a game.” No, it will not. Minecraft is way too big to just shut down. All this lawsuit is aiming to do is revert the damage that has been done. for example, all of the thousands, maybe hundreds of thousands of people that lost their Minecraft accounts because Mojang threatened them and forced them to migrate. And also, maybe we will actually get a clear EOA, a clear document, which is not so headacheinducing as the current one. You know, the one that says selling mods is not allowed, but there are 20 different loopholes you can jump through. Yeah, that one would be great to have more clarification.
