I think it’s a 25% chance to be occupied every time after the first time you see a movie. So you’ve just gotten unlucky!
The first time you see a movie, it will always be occupied. Also, it’s always occupied after the movie is finished

I haven’t used the movie theater all that much, as by the time I get it, I basically have everyone maxed out, but my memory is that if the game is occupied before the movie, it’s free to play afterwards.
Might be the case I’ve just gotten lucky with numbers and/or am misremembering.
